As previously announced, 8000 Inc. (EIGH.pk) is volunteering information to the SEC relating to (i) the proposed merger with a non-shell trading Bulletin Board company as well as (ii) its demonstrable evidence regarding its concern about a suspected manipulation including a naked short position, in its common stock (estimated by the Company to be an amount greater than twice the reported float).

Turek (“Turek”), the former president and CEO of Plasticon International, Inc. (“Plasticon”), a Wyoming based manufacturer utilizing recycled plastics. Turek, without admitting or denying the Commission’s allegations, consented to the entry of a Final Judgment that enjoins him from violations of Sections 5(a), 5(c), and 17(a) of the Securities Act of 1933, Sections 10(b) and 15(a) of the Securities Exchange Act of 1934, and Rule 10b-5 thereunder; finds him liable for disgorgement of $2,600,000, plus prejudgment interest in the amount of $557,836.41; prohibits him from acting as an officer or director of a public company for 5 years; and bars him from participating in any offering of penny stock. Based on Turek’s Statement of Financial Condition, the Court did not order Turek to pay a civil penalty, and waived payment of disgorgement and prejudgment interest.

According to the SEC’s complaint in this matter, between at least January 2005 and April 2007, Turek fraudulently misappropriated for personal use at least $2.8 million of proceeds from a $8 - $11 million unregistered, multi-state securities offering by Plasticon, the public company controlled by Turek. Turek previously represented to investors that the proceeds from the offering would be used in Plasticon’s business. The complaint further alleged that between at least May 2005 and April 2006, Turek and Plasticon made false and misleading press releases relating to Plasticon’s financial condition, Plasticon’s ownership of patents and the value of those patents, and Plasticon’s outstanding shares. Kensington Oval will be the site of the 2011 AC Milan Junior Camp in Barbados from October 15 to 23.

An ecstatic Greg Castagne of Pro Shottas told the Nation following discussion with officials at Kensington Oval earlier today, they were able to secure the venue and it could become an annual arrangement.

The football camps are also used for scouting and securing talent for the Serie A club’s feeder programmes.

“We wanted to get the best facility. We are overjoyed to get Kensington Oval and AC Milan will get the best facility,” Castagne.

“It is a world-class facility for a world-class event,” sponsor Jonathan Bryan of 8000 Inc. added.

The event was originally scheduled to be held at the National Stadium. However, Castagne said they would be reducing the number of participants from 75 to 60 because they wouldn’t be able to use the square at the Oval.

A section of the venue, dubbed the Mecca of West Indies cricket, will be used for matches, while another part will be used for skill displays.

“We want as many kids as possible to benefit from the experience. If the camp isn’t going to suffer in terms of quality we will increase the numbers, but right now we can guarantee 60,” Castage said.

Officials at Kensington Oval have also made the media centre and conference facilities available. A former top associate of Lou Pearlman was sentenced to three years in federal prison Wednesday for his role in the disgraced music mogul's scheme that bilked investors out of hundreds of millions of dollars.

Robert Fischetti pleaded guilty in Orlando federal court in June to one count of conspiracy and three counts of failure to file an income-tax return.

Fischetti played key roles in many of the companies Pearlman set up.

Pearlman, who founded the Backstreet Boys and 'N Sync, is serving a 25-year sentence for orchestrating one of the largest Ponzi schemes in the state.

He pleaded guilty to running a $300 million investment scam in connection with the sale of worthless stock and retirement-account investments in Trans Continental Airlines and Transcontinental Airlines Travel Services.

In Fischetti's case, federal prosecutors said Trans Continental Airlines offered people the chance to invest in what it called an Employee Investment Savings Account program.

But that program was nothing more than a Ponzi scheme, using newer investor money to pay off earlier contributors.

Fischetti managed the investor database for the EISA program from offices in Orlando at times from 1989 to 2007, his plea agreement said.

Fischetti sent statements falsely showing investors' money was earning interest.

More than 1,500 people invested over $200 million in the EISA program, the agreement said.

Fischetti also failed to file personal tax returns for three tax years while earning nearly $1 million.

I honestly don't care about the company. Fluff PRs, botched dividend, and no sign of a merger or acquisition yet have not exactly improved my confidence in fundamentals. However, I only care about the NSS and their ability to flush it out into the open. If they can do that, then I will gladly re-evaluate when this is all said and done.

Your questions obviously have answers people are unwilling to truthfully state. Pretty much sums it all up.

As for how terrible EIGH is or isn't, it doesn't matter. They can knock on it or any other company all day long but it literally has zero importance. Abusive NSS is illegal regardless of whether the company is good or bad and since most of us are holding because of the NSS issue, fundamentals are irrelevant. If they really want their shares back, they would be better off proving the NSS doesn't exist. This of course is impossible, so they choose to ignore it and divert attention elsewhere.

The fundamentals don't matter anymore. I'm not sure why everyone is arguing over it. I couldn't care less about whether they lied or didn't lie, incompetent or not, scam or whatever. Let's stop dancing around the primary point in question here.

We say there is a large unrecorded short position. They say there isn't. If we don't sell, they can't cover. If there is no large unrecorded short position, they don't need to cover. At some point, these conflicting statements will come to a head, but neither side is relenting nor will they until forced to.

The Ontario Securities Commission wants the Sulja Brothers "pump and dump" stock fraud schemers to give back almost $6 million in profits.

But mostly blaming each other at a sentencing hearing Tuesday, the five Windsor-area residents convicted in the fraud said they're broke.

"The money I have in my pocket is all I have," said Petar Vucicevich after an OSC hearing Tuesday was told he alone made about $3.5 million from the stock fraud.

Nicknamed "Black Pete," Vucicevich surprised his Colchester Village neighbours when he began driving a Range Rover or a Maserati and flashing big rolls of money when Sulja stock was being hotly traded in an electronic, over-the-counter market called the Pink Sheets in 2006 and 2007.

The penny stock scheme was concocted to bail out the small Harrow-area lumberyard founded by John Sulja more than 20 years ago, but struggling to survive the building slump that began in 2005.

Vucicevich said about $1 million made from the stock sales went back into the lumberyard or an expansion effort out west.

"Nobody walked away with bags full of money," Vucicevich said.

Vucicevich claimed one of his lawyers kept $350,000 of his money that was supposed to pay his taxes. Revenue Canada is now chasing him for $240,000 in taxes owing, Vucicevich said.

Vucicevich blamed his Texas partner Andrew DeVries and a slew of lawyers for bad advice that led him and others to think what they were doing was legal. "I should have been a lot smarter," he said.

Vucicevich claimed DeVries was the mastermind of the scheme and wrote all the press releases.

"This is quite simply an egregious case of fraud," said OSC lawyer Usman Sheikh.

Sheikh said close to 500 million shares of Sulja stock were sold at inflated prices to investors while 100 or so press releases were issued claiming business deals worth hundreds of millions of dollars were being made.

"The respondents were in effect printing money," said Sheikh. There is "not a scintilla of evidence to support the vast majority of their claims," he said.

Sheikh asked for a $750,000 fine against both Vucicevich and DeVries, and a "disgorgement" order that would attempt to seize money and other assets realized from the fraud. Anything recovered would go into an OSC investor education fund.

Fines of $125,000 each were sought against brothers Steve and Sam Sulja, Pranab Shah and Tracey Banumas as lesser figures in the stock fraud.

Sam Sulja made $100,000 in one stock trading account in his name while another account he managed in his father's name showed a $350,000 profit, the OSC said.

Banumas had a $110,000 profit in a stock trading account in her name, while the OSC said Shah's account showed a $200,000 profit.

Lawyer Khalid Sheikh (not related to the OSC lawyer), represented Sam and Steve Sulja and said the brothers trusted Vucicevich, who wrote the press releases and directed the stock trading.

The defence lawyer said Sam and Steve Sulja have since found work as labourers and Steve lost his house after the stock investigation.

Banumas said she went to work for Vucicevich as an office administrator and was told the stock sales were legal. She's now living in her mother's basement in Kitchener and hasn't found new work.

"If I had $110,000 in my bank account now, I'd be pretty happy," Banumas said. She does volunteer work for the local police department to keep busy.

Shah, a University of Windsor grad, said he was originally hired by Vucicevich as a planner, and knew little about stocks. He's now working as a consultant while trying to finish a master's degree at the University of Waterloo.

Shah said his Windsor immigration lawyer Ayemand Haddad advised him the stock sales were legal. "I got the green light from my attorney," he said. "It was an honest mistake in a way."

Vucicevich asked for a one-year delay on any fine imposed so he could defend himself on a criminal fraud charge laid by RCMP, who also investigated the penny stock sales. Vucicevich said he couldn't afford a lawyer.

OSC hearing panel members Patrick LeSage and Senan Akendiz reserved a decision on the sentencing. LeSage warned Vucicevich that the odds weren't good for getting the one-year delay.

The owner or Ryan Manley Enterprises LLC, promoter Ryan Manley, has been pumping and hyping EIGH all over the message boards with the alias "ryanmnly". Monk has said he was in the Navy between 1985 and 1989. That would mean he enlisted directly out of high school. Reports have it that he claims to have been an officer serving on nuclear subs. But how on earth could he have got through basic training, sub training, college and officer's training school in four years?

Monk himself set up a Linked In page for his Five Star Property Services company. On it he said he "attended" CCSU between 2002 and 2006.

Some thoughts from an ex-CDIV believer…

I discovered the FLD’s back at the start of the year and invested some in both E and CDIV back in Jan. I gradually sold other stuff and invested a bit more in E and a lot more in CDIV as it started to move up. I became so convinced that the FLD idea was legit as CDIV moved from .06 to .40 that I signed up for the PHX Monkinar. I actually don’t regret going to that. It really wasn’t about the FLD’s. It was mainly Monk’s techniques for reading charts and day trading. It was, however, pretty basic stuff that you could pick up from reading any decent webpage on charting (and most of it I already pretty much knew). It was also nice to meet a lot of the people behind the aliases. I have to say that I still believe most of the people involved in these things are good people that genuinely mean well and care about each other.

In PHX, we did discuss CDIV and the FLD’s briefly. A few things bothered me about the discussion. The first was that there was no one who was involved with the supposed EV** short squeeze that was still around. They were all rich and retired and in hiding now. The second was that Dr. Jerry could never really give a compelling reason why the MM’s would dig so deep a hole to create such an amazing squeeze or what would be the catalyst to trigger it. The third was the fact that Jerry said he wasn’t going to teach us how to screen for chart plays as he didn’t want to distract us from putting our money in the FLD’s. I know. I know. Big red flags. However, it was easy to ignore all that when my .10 average price CDIV shares were running up several 100 percent.

Like a good team player I hit the ask much of the way up as I watched CDIV reach 0.70. I didn’t sell a share even though I knew selling some on the run up to lock in profits was just good common sense, but I didn’t want to hurt the team. I watched CDIV trickle all the way back down into the teens, again never selling a single share. It was when the G stock also ran up to 0.70 and started a similar fall at the end of the summer that I started to really question the whole FLD idea. When the FLD hype got pulled from the den ibox and the Monk was too busy flying his plane to support his troops, I really started to worry. I did some digging into Monk’s old posts on the hub and into the EV** story. I discovered that EV** was not a short squeeze but a pumpfest galore during its crazy run up (try googling “riding hype to the moon” and check out the first result from Canada that shows up). I soon became convinced that the whole FLD idea was nothing more than wishful thinking at best and an outright, if not illegal, scam at worst.

In early September, I decided to exit both E and CDIV. It was just a question of when. I got lucky with E and was able to ride the hype up before I got out. I started selling both of them the day after the absolutely ridiculous E divi PR. It that didn’t convince you the FLD thing was bogus, I don’t think anything will.

So why I am saying all this now? I just think it’s the right thing to do. I wish I had done it sooner before everything had completely collapsed. I’ve met many of you in person and think you’re decent, honest people, but I also believe that a squeeze is never going to happen. Some of you have risked your entire savings and even mortgaged your home in the hope of making it rich off of this crazy idea. If this post ends up saving even one person from flushing what’s left of their money down the toilet, then it’ll be worth it. We’re all grownups, and each of us must make our own decisions, but if you’re going to stay in this thing at least think through some of the stuff that has happened in the past couple months. Look at how Monk has handled this. Look at how these stocks have behaved, and consider what people like XB are saying. Not everyone who questions what is going on is a basher or an MM plant (do you seriously think the MM’s have time for message boards?). Some of the people around here have a lot of experience in the wild west of the pinkies and seem to be straight shooters with believable answers.

I’ll admit that part of me wants to believe this whole FLD thing is just a sincere but misguided idea that went bad (no harm, no foul), but given everything that has happened, that seems as likely as CDIV actually squeezing one day. I genuinely hope it’ll work out well for those of you still holding and buying, but all the evidence indicates that these things will be sub-penny soon. I’ll confess that it’s hard to admit I got taken in by the craziness, but I suppose admitting I got taken in is the first step to not getting taken in again.

Been doing some DD from this board and have reached the following conclusions...

1. Monk has not served in the military
2. Monk owns no stock in any of his plays
3. Monk's company Monk's Den is not making any money
4. Monk, however is filthy rich because he has sold all his shares (see #2)
5. Monk's company is private and therefore cannot be a subsidiary of a public company
6. Monk's Den acquisition did not happen
7. Monk does not have a PHD
8. Monk is a patsy, designed to fleece us of our money and set in place by International Money men
9. SEC and DOJ are investigating EIGH
10. All shareholders who intended on making money with this stock are definitely going to jail
11. EIGH does not have a real office
12. EIGH does not have any inventory
13. EIGH does not have any profits
14. EIGH does not have anything in Barbados
15. EIGH is diluting because 172,000 shares traded b/w the bid & ask yesterday (my personal favorite)
16. EIGH is diluting because a 10,000 share t-trade went through before the open this morning
17. EIGH not providing a dividend means the company is crashing
18. EIGH is going in the tank and we've all been had

So in summary, Monk obviously does not exist. We've seen pictures of him, but never really met him. In fact someone posted a picture yesterday that had him bearing a similar resemblence to an Alpaca. Therefore, the conclusion I have come to is the Monk is a robot alpaca designed by and operated by Internation Hedge Fund operators who have orchestrated this whole scenario to fleece us, the innocent shareholders, of our hard earned investment money. We need to sell now in order to save ourselves from impending doom and our own destitution.

The former British footballer is so enthused over the life he leads in this “paradise” that he is making plans to give back in a big way.

In the years of visiting Barbados, Bryant struck up friendships on the golf course, including with Sir Garfield Sobers and Desmond Haynes. Through these friends he met many others in the sports field and watched golfers, athletes, footballers and other sportsmen and sportswomen in action.

He was impressed with what he saw. “When I first came here I met a couple of young athletes. I just felt they did not have the opportunity because of the infrastructure in Barbados,” Bryant said during the interview with the Weekend Nation beside the large swimming pool at his well appointed Sandy Lane home.

“The problem is there is lots and lots of talent in this island in sports. Typically, [this is] what happens: anybody with any talent in sport, if they are spotted by an English premiership football club or an English college, they are plucked and taken away. That takes something away from Barbados.

“I thought that was a shame and I just did some more digging into what was going on. Whether it is right or whether it is wrong, the people believe that not enough is given back.”

As he looked out towards the azure Caribbean Sea on a sunny day, Bryant remarked: “I have been fortunate in my life. But that was not all the time. I had my moments where I had been penniless. But things are good now. So I wanted to do something special out here.”

Bryant is also concerned about the future for young Barbadians.

“Other than tourism there really isn’t any industry left on the island. Once you have built all the houses and there is no more land, what do you do?” he said.

He saw “huge” potential problems ahead. That is why he has been supporting the Carlton Club, because he believes that club emanates from a community where many young people benefit from membership. His generosity in cash and advice is known by people in sports administration, as well as by thesportspeople themselves.

He attended the Sentabale Polo Cup match, where Prime Minister David Thompson spoke about the importance of developing sports tourism and he pondered on the message.

“I actually think that there is a real opportunity on this island to build that into more than just words.”

Bryant is taking action. He is moving his business interests to Barbados, and through 8000inc, one of the businesses he founded, he plans to do even more than he is already doing. He is already committed to the Amateur Athletic Association of Barbados, the Barbados Golf Association, the Carlton Club and to developing centres of excellence with former West Indies opening batsman Desmond Haynes.

8000inc will be opening a store at the upscale West Coast development Limegrove later this year, and Bryant said ten per cent of every dollar spent in the shop will go towards the sports he supports.

So elated is Bryant about the life he is able to enjoy in Barbados, being able to share a golf game and socialise with two of Barbados’ cricketing heroes, that he remarked: “There is nowhere in the world that you can get up on a Thursday (the one day he takes off in the week) [and] saunter 500 yards to one of the best golf courses in the world, on the best island in the world and play golf with Desmond Haynes and Sir Garfield Sobers. I still can’t believe it. It just gives me a thrill.”

This leads him to talk about his two big dreams.

“I have two dreams . . . One is to build a Desmond Haynes Sporting Centre of Excellence, a purpose-built facility which will have corporate offices and the equipment for his coaching, as well as football equipment.

“You take the National Stadium . . . You have a world champion . . . The running track is not good enough . . .

“My other dream is I want to rebuild Barbados’ cotton industry.”

It disturbs this self-proclaimed “Barbadian” that “this island produces the best cotton in the world and it is sent all the way to Switzerland to come back here as cloth”.

He estimates the bales of cotton flax lying useless around the island number more than 100, and he confesses having a personal interest in seeing local processing of the cotton cultivated in Barbados. The clothing on sale at 8000inc, the sports wear and casual wear lines, including shirts and men’s trousers, is largely cotton-based.

Bryant once played professional football for the Cheshire football club Crewe Alexander, but developed arthritis and was forced to end his career prematurely. He holds a BSc.(Honours) degree in advanced medical microbiology and advanced medical biotechnology, and worked in these fields, while as he said “making some investments that turned out all right”.

Now that he has adopted Barbados as his home, he is committed to putting his money behind Barbados’ sportspeople.

He reckons that he is “unbelievably” fortunate.

Defendants Collectively Charged with Securities Fraud, Obstruction of Justice, Money Laundering, Structuring, Contempt of Court, and Perjury

A superseding indictment was unsealed today in federal court in Brooklyn charging five additional defendants with crimes relating to Spongetech Delivery Systems, Inc. (Spongetech).1 The superseding indictment includes charges previously brought against Michael Metter, the Chief Executive Officer and President of Spongetech, and Steven Moskowitz, Spongetech’s Chief Operating Officer, Chief Financial Officer, Chief Accounting Officer, Treasurer, and Secretary.

Today’s superseding indictment charges former Spongetech employees Andrew Tepfer, Seymour Eisenberg, Thomas Cavanagh, and Frank Nicolois, as well as former Spongetech vendor George Speranza. Tepfer, Eisenberg, Nicolois, and Speranza were arrested this morning. Their initial appearances are scheduled today before United States Magistrate Judge Robert M. Levy at the United States Courthouse, 225 Cadman Plaza East, Brooklyn, New York.

The charges were announced by Loretta E. Lynch, United States Attorney for the Eastern District of New York, Janice K. Fedarcyk, Assistant Director-in-Charge of the Federal Bureau of Investigation, New York Field Office, and Charles R. Pine, Special Agent-in-Charge, Internal Revenue Service, Criminal Investigation, New York.

As alleged in the superseding indictment, between January 2007 and May 2010, Tepfer, and Eisenberg, together with Metter, Moskowitz, and others, executed a fraudulent scheme to publicly report materially overstated Spongetech sales figures to create artificial demand for, and increase the share price and trading volume of, Spongetech common stock. Tepfer and Eisenberg face one count of conspiracy to commit securities fraud, one count of money laundering conspiracy, and one count of securities fraud.

Cavanagh and Nicolois face one count of structuring and one count of contempt of court. The superseding indictment alleges that from January 2008 and December 2009, Cavanagh and Nicolois cashed checks written in amounts less than $10,000 at a financial institution for the purpose of evading federal currency transaction reporting requirements. The indictment also alleges that in doing so, Cavanagh and Nicolois violated a court order entered in a 2004 lawsuit brought by the United States Securities and Exchange Commission (SEC) against them and others.

Speranza faces one count of conspiracy to obstruct justice, one count of obstruction of justice, and one count of perjury. The superseding indictment alleges that Speranza gave false testimony under oath in an investigation by the Enforcement Division of the SEC into Spongetech’s publicly reported sales figures and financial statements.

If convicted, Tepfer and Eisenberg face up to 20 years’ imprisonment on the securities fraud counts. Cavanaugh and Nicolois face up to 10 years’ imprisonment on the structuring counts. Speranza faces up to five years’ imprisonment on the obstruction of justice count.

The government’s case is being prosecuted by Assistant United States Attorneys William E. Schaeffer and Jeffrey A. Goldberg.

This case was brought in coordination with President Barack Obama’s Financial Fraud Enforcement Task Force. President Obama established the interagency Financial Fraud Enforcement Task Force to wage an aggressive, coordinated, and proactive effort to investigate and prosecute financial crimes. The task force includes representatives from a broad range of federal agencies, regulatory authorities, inspectors general, and state and local law enforcement who, working together, bring to bear a powerful array of criminal and civil enforcement resources. The task force is working to improve efforts across the federal executive branch, and with state and local partners, to investigate and prosecute significant financial crimes, ensure just and effective punishment for those who perpetrate financial crimes, combat discrimination in the lending and financial markets, and recover proceeds for victims of financial crimes.

Before you fall for the hype about this stock read these facts:

1. Smoking Gun SCAM EVIDENCE:

EIGH is using a virtual address which just so happens to be the exact same virtual address of another scam company, EWPI. (WHICH IS ANOTHER of WILLIAMS FLD PLAYS) Oh well, it's about what one would expect.

Its the very same suite number as EWPI uses. It is a Regis virtual office. Lots of total scams use them.

I guess we are meant to accept that this "company" with 12 subsidiaries uses a virtual office? LOL That is funny.

Especially when you consider the fact that EWPI was a Monks Den FLD play as well.

So, we have two FLD plays using the same address at the same virtual office suite number. SCAM is all that comes to mind.

2. MORE SCAM EVIDENCE.

Williams markets himself and Monk's Den (which is part of EIGH) by claiming he is a former naval officer and holds a PHD degree from UCONN.

No one can find any evidence that these claims are true and it is not hard to verify a PHD degree. You see PHD's file their Doctoral Thesis into a world wide database. Interestingly enough, Williams's thesis is nowhere to be found within that database. Is he lying? It sure looks that way.

A man that will lie to you about his education will lie to you ABOUT THINGS OF FAR MORE importance-- Like what he is really trying to do with your money.

3. EIGH ACCOUNTING LOOKS VERY BOGUS.

This is a simple matter which anyone can see whether he or she has a background in accounting or not. The quarterly financial reports filed with pink sheets do not reconcile with one another.

The ending numbers plugged into Q1 and the beginning numbers plugged into Q2 are different. Since the company claims they had no acquisitions during the period there was no consolidated report filed so these numbers should be exactly the same and they are not. It looks as though they just sat down and entered whatever they thought looked good enough to fool you, the investor.

4. The company claims to be setting up a cotton plant in Barbados but shows no assets under plants and equipment. Sorry charlie. That ain't gonna fly.

5. The company claims to be in the clothing business but has no inventories shown in their financial statements. OOPs! That's a dead giveaway that something is seriously wrong with this company's claims.

6. The company claims to be operating 12 subsidiaries but only shows salaries of 42,000 for Q2. That is less than 900 dollars per week in salaries for each sub and what is worse, it shows they still owe the money. Is everyone at all 12 companies working for free?

You see, this is the problem with pink sheet scammers. They never remember to keep their stories straight and are usually outed by their own statements.

7. EIGH claims they will be paying a 10 cent per share cash dividend. The problem is that they do not have enough money in their retained earnings to pay such a dividend and this is an absolute requirement. Additionally, the only dividend they have filed with FINRA is a half penny dividend. They promised to change this by the 3rd of October, but they have not done so. It looks like they have been using lies about a phony divi to induce people to buy their stock.

EIGH? Proceed at your own risk. Let the buyer beware.

TORONTO After almost four years, the first convictions were handed down Tuesday in a local “pump and dump” stock scheme that defrauded hundreds of penny stock investors across North America.

Colchester Village resident Petar Vucicevich was found guilty of securities fraud for his role in the scheme that fraudulently hyped a tiny Harrow lumberyard as a world player in Middle Eastern construction projects and cement deals in the hundreds of millions of dollars.

Vucicevich received close to $4 million out of the stock sales, according to an uncontested statement of facts placed before an Ontario Securities Commission panel.

The OSC also convicted two other Windsor-area participants — Tracey Banumas and Pranab Shah — for lesser roles in the stock scheme. Neither contested the statement of facts filed that outlined their roles in the market manipulation of the Sulja stock.

Hundreds of small investors lost thousands of dollars when they were convinced to buy shares in Sulja Bros. Building Supplies Ltd., a company incorporated in Nevada, but bearing the name of the Harrow lumberyard that had sold building products on a regional basis for more than 20 years.

The stock price collapsed in late 2006 in the wake of the company’s failure to produce a long-promised audited financial statement and The Star’s story of an RCMP investigation into the claims of big deals.

Vucicevich, Banumas and Shah will be sentenced at a later date. Vucicevich is also facing a criminal fraud trial in early 2011 as a result of an RCMP investigation.

The OSC hearing is continuing Sept 24 against some of the participants who didn’t show up at the start of the hearing Monday.

Evidence against Steve Sulja, Sam Sulja and a Texan named Andrew DeVries, and some of the companies involved, will still be produced in their absence.

Vucicevich was at one time the CEO of the Sulja public company incorporated in Nevada, but Steve Sulja later took that position. Adding to the confusion of investors in the penny stock markets were two other privately held Ontario incorporated companies using the Sulja name, but never merged with the publicly traded company.

Another company controlled by Vucicevich – Kore International Management Inc. – was also charged in the stock fraud. All of the Sulja and Kore companies ceased operations amid the scrutiny of an 18-month OSC investigation and interim orders.

Vucicevich, who defended himself, told OSC commissioner Patrick Lesage Tuesday that he preferred to be sentenced after all the evidence about the scheme had been submitted and the roles of each participant made clearer.

The stock has been virtually worthless for years, typically trading in low volumes for less than a cent a share. At the peak of the hype, the price got up to about 21 cents a share.

Lynch, United States Attorney for the Eastern District of New York, George Venizelos, Special Agent-in-Charge of the Federal Bureau of Investigation, New York Field Office, and Patricia J. Haynes, Special Agent-in-Charge, Internal Revenue Service, Criminal Investigation, New York.

As alleged in the complaint, between approximately January 2007 and May 2010, the defendants Michael Metter and Steven Moskowitz, and others, executed a scheme to defraud Spongetech’s existing and potential investors by publicly reporting — in its filings with the United States Securities and Exchange Commission (SEC) and in numerous press releases — false and grossly overstated sales figures. Specifically, Metter and Moskowitz publicly reported that Spongetech had secured purchase orders from and/or had made sales to five customers that, in reality, did not exist. The complaint charges that the amounts of these orders and sales were material. For example, for the nine months ended February 28, 2009, Spongetech reported that sales to these five customers constituted approximately 99% of Spongetech’s revenue.

The complaint states that beginning in or about early September 2009, the SEC’s Enforcement Division issued subpoenas to various entities and individuals, including Metter and Moskowitz, as part of its investigation of Spongetech. Since then, Metter and Moskowitz allegedly obstructed the SEC’s investigation by fraudulently attempting to fabricate the existence of the five purported customers by (1) seeking to create Internet websites and virtual offices for the customers, (2) furnishing phony purchase orders purportedly issued by the customers, and (3) producing documents they falsely claimed were proof of payments by the non-existent customers.

According to the complaint, Spongetech designs, produces, markets, and sells various cleaning care products, including pre-loaded soap sponges such as the SpongeBob SquarePants soap-filled bath sponges for children. Its headquarters is in New York City, and its shares trade over the counter.

“The defendants in this case — Spongetech’s highest corporate officers — are charged with executing a bold scheme to portray Spongetech as a company that was performing at a level far above reality,” stated United States Attorney Lynch. “As detailed in the complaint, the audacity of their scheme was matched only by their obstructive efforts during the course of the SEC’s investigation. This Office will use all available resources to protect investors from fraud.”

Ms. Lynch thanked the SEC for its assistance. The SEC today filed a corresponding civil complaint in the United States District Court for the Eastern District of New York.

FBI Special Agent-in-Charge Venizelos stated, “As charged in the complaint, the blatant fraud carried out by these defendants went beyond fictitious reporting of sales and receivables to inflate Spongetech’s financial condition. They allegedly created out of whole cloth the very existence of some of the companies with which they claimed to have done business. The FBI is committed to protecting investors and preventing the windfall of unjust enrichment that comes of fraudulent schemes like this one.”

IRS Special Agent-in-Charge Haynes stated, “These recent enforcement actions should serve as a continued warning to those involved in financially based fraud schemes. IRS Criminal Investigation remains committed with our law enforcement partners in bringing those responsible to justice.”

If convicted of conspiracy, each defendant faces up to five years’ imprisonment.

This case was brought in coordination with President Barack Obama’s Financial Fraud Enforcement Task Force. President Obama established the interagency Financial Fraud Enforcement Task Force to wage an aggressive, coordinated, and proactive effort to investigate and prosecute financial crimes. The task force includes representatives from a broad range of federal agencies, regulatory authorities, inspectors general, and state and local law enforcement who, working together, bring to bear a powerful array of criminal and civil enforcement resources. The task force is working to improve efforts across the federal executive branch, and with state and local partners, to investigate and prosecute significant financial crimes, ensure just and effective punishment for those who perpetrate financial crimes, combat discrimination in the lending and financial markets, and recover proceeds for victims of financial crimes.

The government’s case is being prosecuted by Assistant United States Attorneys William E. Schaeffer and Jeffrey A. Goldberg.

Why is this important?

SPNG has been issuing massive amounts of common shares while claiming that they have been doing share buybacks. The 10-K , with audited financials and current oustanding share figures, would show that they have been lying to its stockholders - so SPNG management will be making every effort to delay this 10-K filing with the SEC. Scam company SPNG last released its outstanding common share figure on April 20, 2009 as of April 16, 2009 on its 10-Q filing with the SEC. Yes.

Outstanding shares are shares that have been issued. Issued and outstanding are shares that are held. Further stock that is in the company's treasury, is considered Outstanding but not issued and outstanding.

Now lets look at what happened

The company put out a PR saying that they returned x shares to the company's treasury thus reducing the Isussed and outstanding down to aprox 700 million.

Then when the 10q came out and the company fully canceled these shares prior to the 10q to reduce not only the issued and outstanding but the Outstanding to 700 million. The people said they lied.

Yet they claim that the issue at hand is they are saying the company didn't put the stock in the company's treasury, of which they have no proof for. Only a misunderstanding of what issued and outstanding is. Assuming that because the Outstanding shares didn't go down that the company was lying, even though it wouldn't go down for returning the shares to the company's treasury.

This has been twisted endlessly to try to confuse the naive of what really happened.

NAR SAYS ..... Some are saying that the naked short position in this stock is zero. They may be saying that because they are working for a hedge fund that actually has a NSS position in this stock and it is their job to try and discourage people from buying or holding this stock. One way to determine whether or not it is in a particular persons interest to deny the existence of a NSS position is very simply to examine that persons posting history. Look for posts with a negative agenda with a pattern of repetitive posts harping on the same subject time after time. There is a good chance that the person being examined is a paid basher and you can expect that he or she is going to pooh, pooh a NSS position. Paid bashers would not be here if there were no NSS position to protect. Hopefully it is obvious to most posters on this board who the paid basher candidates are even though they claim otherwise.

NAR SAYS ..... I would also point out that if phantom shares exist in the market place for this stock, those phantom shares were created via an illegal NSS position. MM's go naked because that is required in the course of their everyday business. Reg SHO monitors this and these positions are bought in by the MM which resolves their short positions. It is the illegal NSS positions that are the problem. I have already posted a tentative accounting for 883.5 MM SPNG shares which indicates that there must be phantom shares trading in the market place. 94 MM treasury can be eliminated from this list because those shares have not been bought back yet, leaving a total of 789.5 MM shares accounted for. This number exceeds the issued shares of 723 MM. Is impossible to have more shares accounted for than have been issued unless there are in fact "phantom shares" in existence. NAR SAYS ..... Adding to the list doesn't make the problem go away. The unknown is the number of phantom shares existing in the market place. The plus side is that there is a very good chance that a very large NSS position still exists on this stock and when the stock does make a sustained move to a higher lever, those who hold these positions are going to have a hell of a time trying to cover. It's just a matter of time. Sooner or later the market will acknowledge this fundamentals of this company and buy up the shares in the open market. Meanwhile the company itself is engaged in buying shares as is the individual members of management of this company. The noose tightens slowly sometimes, but in does tighten. Any hedge fund short this stock is in trouble and their paid bashers don't seem to be very effective. We all pretty much know who they probably are and what their recycled arguments are.

NAR SAYS ..... My own conclusion so far is that there are SPNG "phantom shares" traading in the market place and that the very exsistence of these shares is evidence that an illegal NSS position created these shares. The way this stock took off when it ran from $0.03 to $0.28, I doubt that the NSS positions were covered. That position seems to be supported by the existence of so many paid bashers on this board.

nicehit, I'm not saying what management did is fair. Fair would have been to do what it stated in their conversion offer without adding to it after the deal. However, things unforeseen to management occurred that caused - in their best opinion - the absolute necessity to attach an addendum (RS of convert' prefered) to their stated offer.
I don't like what happened either. I converted 65% of my xxis and had 35% RS that subsequently fit nicely into a thimble. Fortunately I bought more oncp after the xxis RS and sold recently near the top. I'm still in the hole thousands of dollars. You can bet I don't like it !
What's done is done....and gone. I'm focused on the future with a better understanding of the management team's weaknesses and strengths.

Stocker is scheduled to be sentenced on Nov. 6, 2009, by U.S. District Judge Liam O'Grady. The maximum penalties for the conspiracy charge are five years in prison and a $250,000 fine.

Stocker pleaded guilty to a criminal information charging him with one count of conspiracy to commit securities fraud involving 19 publicly traded companies including: eDollars Inc; Emerging Holdings Inc.; MassClick Inc.; China Score Inc.; American Television and Film Company Inc.; Auction Mills Inc.; Custom-Designed Compressor Systems Inc.; Ecogate Inc.; Media International Concepts Inc.; Vanquish Productions Inc.; AVL Global Inc.; Motion DNA Corp.; PokerBook Gaming Corp.; TKO Holding Ltd; Body Scan Inc.; Integrity Messenger Corp.; Beverly Hills Film Studios; IFINIX Inc.; and V3 Global Inc.

In related actions, the U.S. Securities and Exchange Commission (SEC) has enforcement actions against Stocker pending in federal district courts in Arizona, Michigan and Texas.

According to the plea agreement and criminal information, the stock manipulation scheme employed by Stocker and his co-conspirators followed a common pattern. Stocker admitted that he acted as securities counsel for companies, and he and others fraudulently caused the companies to issue millions of "free-trading" shares to co-conspirators in transactions that had not been registered with the SEC. As Stocker acknowledged in his plea, after the unregistered and free-trading shares had been issued, co-conspirators began to manipulate, or "pump," the trading value of the companies' stock through a number of deceptive and manipulative means to entice members of the investing public to invest in the stock. For example, according to court documents, members of the conspiracy engaged in coordinated trades to manipulate the price of the stock.

Stocker also admitted that co-conspirators falsely manipulated the price and volume of some of the companies' stock by making materially false and misleading statements in press releases and in spam emails distributed by co-conspirator Justin Medlin and other spammers to tens of millions of email addresses throughout the United States in an effort to create artificial demand for the companies' stock. After fraudulently "pumping" the market price and demand for the companies' stock, co-conspirators "dumped" millions of shares by selling them for large profits to the general investing public in the over-the-counter market through listings on Pink Sheets, an inter-dealer electronic quotation and trading system. These shares were purchased by unsuspecting investors, including investors in the Eastern District of Virginia, and were often rendered virtually worthless.

Eight other defendants have pleaded guilty and have been sentenced in federal court in Alexandria, Va., for their roles in related stock manipulation schemes. Michael R. Saquella was sentenced to 10 years in prison; Justin Medlin was sentenced to six years in prison; Steven P. Luscko and Gregory A. Neu were each sentenced to five years in prison; Lawrence Kaplan was sentenced to three years in prison; Brian G. Brunette was sentenced to a one year in prison; Anthony Tarantola was sentenced to six months in prison; and Henry "Hank" Zemla was sentenced to three months in prison.

The case, which was referred by the Financial Industry Regulatory Authority (FINRA), was investigated by the FBI and the U.S. Postal Inspection Service, with assistance from the Virginia Securities Division. The case is being prosecuted by Assistant U.S. Attorneys Patrick Stokes and Ed Power of Eastern District of Virginia and Deputy Chief Steve Linick of the Criminal Division's Fraud Section. The Department of Justice acknowledges the substantial assistance of FINRA and the SEC in its investigation. Security Services. Labwire (dba Labwire Security, Inc.) contracts with American K-9 Bomb Search, Inc., which is one-half owned by Labwire’s Chairman and Chief Executive Officer, to perform security services. Labwire Security, Inc. is fully licensed with the State of Texas. This security model features a web based solution for reporting and record keeping delivered with a traditional hand on type product giving client security managers the ability to manage more locations more securely, effectively, and at lower costs. A typical weekly consolidated, online report to a client would contain the numbers and types of vehicles entering, license plates numbers, rail and marine traffic, incident reports, the times of entering and leaving, observations of persons and contents, etc. These reports now allow for the efficient use of resources by security services and client resources to be managed globally rather than autonomously as now done in most industries. Labwire is paid a 5% commission for the K-9 security services that it refers to Labwire Security, Inc. The commissions received by the Company have been less than 1% of the Company’s gross revenues.

Review and Comments from the_worm06:

1. LBWR says that it contracts with "American K-9 Bomb Search, Inc." for security services, yet a review of the website for the Texas Department of Public Safety shows that "American K-9 Bomb Search, Inc." is not registered to do business in this area.

2. In fact, in addition to "American K-9 Bomb Search, Inc.", the Agreement attached in the same form 10 SEC filing listed above lists two other similar sounding entities as "American K-9 Bomb Search, Inc." These other entities are "American K-9 Services, Inc." and "K-9 Commercial Services, Inc."

3. To add further to the confusion, a fourth similar sounding entity has been found - "American K-9 Interdiction, LLC", which is tied to related parties of the above.

4. Further, the corporate entity, "Labwire Security, Inc." listed above as a "dba" entity for LBWR is not listed as a "dba" or "Assumed Name" in the State of Texas. Nor is it registered as a corporation in the State of Texas. Nor is it registered to do business in the security services area in the State of Texas Department of Public Safety website.

4a. LBWR states that it is paid a 5% commission for the K-9 security services that it refers to Labwire Security, Inc., but this cannot occur, because LBWR cannot pay a commission to itself.

5. Instead, what has been found, is that an entity not mentioned at all in LBWR's SEC filings, "Labwire Security Services, Inc." is registered as an "Assumed Name" for LBWR in the State of Texas.

6. In addition, this same entity, "Labwire Security Services, Inc." is registered with the Texas Department of Public Safety to do business in the security services field.

7. In the same registration document with the Texas Department of Public Safety, LBWR (with the assumed name of "Labwire Security Services, Inc.") states that it has 7 current and former employees that are licensed in the security services area. A review of each of these employees shows that only one of the 7 employees is not currently employed by LBWR.

8. As further verification of the LBWR direct employment and direct payment for employees involved in the security services business, LBWR has issued press releases about their substantial personnel and expense payments in the area of security and surveillance services.

9. Furthering the deceptive ways of LBWR, it issued several press releases discussing the substantial business that LBWR had obtained in the area of security and surveillance without identifying that the business was all going to a private company that is ZERO percent owned by LBWR and that LBWR would only receive 5% of those revenues.

10. As it turned out, LBWR CEO Dexter Morris owns 50% of the private company involved in the security services business that LBWR claims it has contracted.

11. Making matters worse, LBWR funded the initial expenses of more than $250,000 of the private security services company WITHOUT getting an ownership in the equity of the company.

12. A review of LBWR financial statements filed with pinksheets and the SEC results in the conclusion that LBWR wrote off its approximate $250,000 advances to the private security services company, never to receive a payment back of these $250,000.

13. It appears that the $250,000 in funds advanced to the private security services company by LBWR came from cash received from Private Placements in which LBWR's former Securities Attorney, David B. Stocker was involved in. Stocker has been charged with securities and other fraud by the SEC in 3 separate lawsuits.

14. In addition to Stocker, it appears that other investors that have been charged with securities fraud by the SEC were also involved in the private placements that led to the raising of the $250,000 that was advanced to the private company by LBWR.

15. So you have LBWR funding the initial expense amounts of a private security services company without getting an equity ownership in the company - instead the ownership, 50% ownership, goes to LBWR's CEO Dexter Morris. You also have LBWR using its LBWR employees and paying its LBWR employees for security services work that it has contracted a private security services company to do, but the company that was contracted is not registered to do business in the area and LBWR is only receiving 5% of the revenues.

Securities commission ‘looking into’ company activities

The gate at the former Perihelion Opp property is locked tight. The company must vacate the property by early March.

The contract between Perihelion Global and the city of Opp has been dissolved, and all the land and permanent structures have been deeded back to the city.

City attorney Wesley Laird said Tuesday the two entities entered into an agreement Dec. 5 that stipulated all real estate and property be turned back to the city.

In the agreement, Perihelion Global CEO John. H. Beebe was given 90 days to vacate the property.

“It was an amicable ‘going our separate ways,’” Laird said. “Mr. Beebe has released all claims (to the property) since he feels that due to the current severe recession, the downturn of the national economy, the disruption of the capital market and the decrease in fuel prices, it would not be feasible to construct a bio-fuel refinery.”

Under the original contract, Beebe had until Feb. 13, 2009, to build a manufacturing facility, employ 20 people upon completion and employ 100 people within three years. He reported he would locate in Opp with a $20 million investment in building and equipment.

In its three-year history, the company was plagued with declining stock prices and a series of financial issues. Production at the plant was delayed numerous times, and in September, The Star-News reported power to plant was disconnected and two local companies had placed liens against the company for non-payment.

However, Beebe maintained the company would meet its February deadline.

Now, that will not happen.

Robert Boothe, who served as head of Perihelion’s corporate media relations, said Tuesday he resigned his position with the company “several months ago” and is now serving as a liquidator.

“I’m not being paid,” Boothe said. “I’m here trying to satisfy the local liens. I just want to see the people (in Opp) get paid the money they’re owed.”

While Laird said the company was paid up on its rent to the city, Boothe acknowledged there are at least three liens on the company by two local residents and one Dothan company. He also confirmed he had been interviewed by the Alabama Securities Commission concerning the company’s operation.

“I do know that complaints have been filed,” Boothe said. “The ASC just wants to know what was going on with (the company) and about their stock.”

Dan Lord, public affairs manager for the ASC, said he can’t confirm or deny a formal investigation, but did confirm the ASC is “looking into it.”

Laird said Perihelion Global is to retain all moveable structures on the property, such as the mobile home and tanks. The “tent building, as people call it” is a permanent structure and will remain on the property, he said.

“This project really has not had any significant cost to the city,” he said. “In fact, right now we’re entertaining a prospect for the property. We’ve got some good things that are about to happen in Opp.”

“Good things” that will include an announcement “pretty soon” on a company who has decided to locate in the 40,000 spec building behind the former Perihelion property, Laird said.

Attempts Tuesday to reach Beebe and his attorney Julian McPhillips were unsuccessful.

(LBWR) by the company and its promoters, it turns out that its Net Income dropped significantly for the 9 months ending September 30, 2008 from the same period in 2007, by 57% to only $145,367 - with a 10% drop in Revenues for the same period. One must remember that during the last few years, the company and its promoters were saying that this was a fast growing company, with all those new contracts signed by LBWR with those humongous companies.

Stock market manipulation results in criminal charges

WINDSOR, ON, Dec. 15 /CNW/ - The Toronto Integrated Market Enforcement
Team ("IMET") of the Royal Canadian Mounted Police arrested and charged Petar VUCICEVICH, age 43, of Harrow, Ontario, with two counts of Fraud. Restraining Orders for 11 real properties, in the Colchester, Ontario area, were also obtained.

The investigation began following a referral from the Ontario Securities Commission ("OSC"). The charges relate to allegations that between July 31, 2006 and December 31, 2006, VUCICEVICH orchestrated and participated in the market manipulation of the shares of Sulja Bros. Building Supplies Ltd. ("Sulja"). Sulja is owned by Sulja Brothers Building Supplies Ltd. ("Sulja Brothers"), a small lumberyard located in Harrow, Ontario. During the time the alleged fraud was perpetrated, Sulja was a publicly traded company quoted on the Pink Sheets in the United States under the symbol "SLJB".

It is alleged that VUCICEVICH, as the interim President, CEO and
controlling mind of Sulja Brothers, caused a number of false and/or misleading press releases to be issued in order to generate and sustain interest of prospective investors in shares of Sulja. Additional shares were issued directly from treasury without cost to VUCICEVICH. The shares were subsequently sold for profit on the public market through accounts allegedly held by nominees. The profits generated from the trading of these shares was in excess of $11.5 million(USD). Police allege that a portion of the proceeds of the fraud were used to purchase the properties for which the Restraint Orders were made. The properties under restraint are valued at in excess of $1 million dollars(CDN).

After taking control of Sulja Brothers, police believe the company was
depleted of assets and it ceased operations earlier this year, putting the
company's thirty (30) employees out of work. A new location was opened in
Calgary, Alberta and was to be known as Premium Building Supplies, however, the business never became operational.

During the two year investigation, Toronto IMET investigators seized
volumes of documentary evidence and interviewed many witnesses including
former employees and owners of Sulja Brothers, business associates, creditors and investors.

Since December 22, 2006, Sulja Brothers, VUCICEVICH and others have been
the subject of a Temporary Cease Trade Order issued by the OSC. A hearing on the merits in this matter is scheduled to commence on November 16, 2009 before the OSC.

VUCICEVICH will appear in court in Windsor later today.

IMET is part of the RCMP's Financial Crime Program and was created to
protect the integrity of the Canadian economy and its capital markets. IMET
brings together specialized investigative skills from the RCMP and
participating agencies. The objective of IMET is to maintain investor
confidence in Canada's capital markets by deterring market fraud and theft through enhanced enforcement and prosecution of serious market fraud and theft offences in Canada. The investigative work of IMET complements the work of the financial markets' regulatory organizations.

"Frauds of this nature have a destabilizing effect on the economy and
shake investor confidence in the capital markets. This particular matter had a
devastating effect on the micro economy in the small town of Harrow. Thirty
people lost their jobs and investors lost a substantial amount of money", said
Superintendent Kevin Harrison, the Officer in Charge of Toronto IMET.

He added, "We hope that the laying of criminal charges in this case sends
a clear message to perpetrators that the IMET's will aggressively investigate
complaints of this nature and, with the assistance of the Attorney General for
Ontario, vigorously prosecute the offenders. We also hope that the restraint
of the properties, a first for the IMET Program, will send a message to
fraudsters that we will also pursue their ill gotten gains."

Integrated Market Enforcement Teams are also located in Vancouver,
Montreal and Calgary as part of the Government of Canada's strategy to combat serious capital market fraud in Canada.

Building Supplies, Ltd. (SLJB), this promoter just doesn't stop with the attacks on the people that have brought out the red flags on LBWR.

the_worm06 had previously correctly predicted that scam company LBWR would have to restate its financials statements filed with the SEC, only to be attacked by promoter Paul S. Davis and others in defending scam company LBWR.

The details of the filings, which will be fully reviewed in this blog in the near future, show that LBWR had to restate its 2007 financial statements previously filed with the SEC, which fraudulently showed Net Income to be a multiple of the actual amount due to hundreds of thousands of dollars in mysterious revenues that somehow showed up in its previously filed financial statements. Among other omissions and misstatements, LBWR also acknowledged that it fraudulently omitted that it had issued 2.2 million LBWR shares to insiders in the 2nd quarter of 2008 - something which was falsely used by the Promoters to pump the LBWR stock by saying that LBWR had gone for a long period of time without issuing new shares, particularly to insiders.

Don't forget there are a lot of aliasses with egg on their faces, who claimed .001 or even .0001. I don't know the percentage of error on those "predictions," but they clearly establish that those who claim to be "always right" are anything but that.

One thing that hasn't gotten a lot of attention that I found interesting was that an accredited investor apparently bought shares for .15. Presumably, this is someone who is in a position to do extensive DD and has made a decision to buy stock. It is interesting also that we regular investors can buy for much less at this point than someone in a position of the accredited investor.

During the first quarter of 2008, the Company sold 100,000 shares of its common stock to a single accredited investor at a per share price of $0.15.
